These terms govern your use of the fitweb platform and services. By signing up or using fitweb, you agree to these terms. Please read them carefully.
Our Acceptable Use Policy and Cookie Policy, as updated from time to time, form part of these terms, and our Privacy Policy, as updated from time to time, explains how we handle personal information. By agreeing to these terms you accept all four documents together.
fitweb is operated by AscendX Limited (NZBN registered), trading as fitweb, based in Christchurch, New Zealand.
fitweb provides AI-assisted lead generation websites for fitness professionals. Depending on your tier, this includes:
All platform sites are hosted on fitweb's infrastructure and live on a {yourbusiness}.fitweb.io subdomain unless a custom domain has been arranged.
You are responsible for keeping your account credentials secure. fitweb uses magic-link authentication: no password is stored. You must provide accurate information when setting up your account and keep it up to date.
You must be at least 18 years old to use fitweb. By using the service, you confirm that you are.
Direct Starter: the one-time fee shown at the time of purchase covers your site build and year 1 platform hosting. From year 2, platform hosting renews annually at the fee shown at that time. All fees are inclusive of any applicable sales tax. We will contact you approximately one month before your renewal is due with a payment link. If you do not renew, your site will be taken offline. No penalty applies for non-renewal.
REPs tier: hosting is included with your REPs registration. If your REPs registration lapses, your site may be suspended. Contact us if you wish to continue independently.
Custom Built: payment terms are set out in your individual scope agreement.
All payments are processed by Stripe. fitweb does not store your card details.
If your site has not yet been generated, you may request a full refund within 7 days of payment by contacting hello@fitweb.io.
Once your site has been generated and published, we are unable to offer a refund as the service has been delivered. If you have concerns about the quality of your site, contact us and we'll work to resolve them.
You own the content you provide to fitweb: your bio, photos, services, and business information. By submitting content through the onboarding form, you grant fitweb a licence to use it to generate and operate your website.
fitweb may also feature your published website in our own marketing: screenshots or short recordings of it, your business name, your web address, and a link to your site. This covers your site as you have published it, shown alongside other fitweb sites. We will not present you as endorsing fitweb, and we will not use your content for any other purpose. If you would rather we did not, email hello@fitweb.io and we will stop. You do not need to give a reason.
You are responsible for ensuring that any content you submit does not infringe third-party rights and complies with applicable law.
fitweb owns the platform, its code, templates, and AI-generated copy structure. These are not transferred to you.
fitweb may also use business information across users in aggregated, anonymised form to produce industry benchmarks and insights, as described in our Privacy Policy. This never identifies you, your business, or your clients.
Your website is built from the information you provide. Some of the copy is your own words used as you wrote them, and some is generated with the assistance of AI from what you supplied. Either way, the published site is yours: you are responsible for reviewing it and for the accuracy of everything on it, including any qualifications, results or claims. You can edit any of it at any time from your dashboard.
You agree to cover any costs or claims we face as a result of content you have provided or published through fitweb.
If you send us suggestions or feedback about fitweb, we may use them without restriction or obligation to you.
Your fitweb site is provided as a hosted service. You can export your leads from your dashboard at any time, and you can request a copy of your other content and data (your bio, images, and business records) at any time (see our Privacy Policy for how to ask).
For platform sites (including REPs, ExerciseNZ, and Direct Starter sites), the template, generated code, design, and hosting are fitweb's, provided to you under licence for as long as your registration, membership, or hosting subscription is active. A Direct Starter site continues for as long as you keep your hosting active, independent of REPs membership. Platform sites are not provided as a downloadable or self-hostable website, and we do not migrate them to another provider.
Your {yourbusiness}.fitweb.io address is licensed to you for as long as your site is active, rather than owned by you. If you add your own domain name, your .fitweb.io address keeps working alongside it. If you ask us to change your .fitweb.io address, the previous one stops working immediately and becomes available to others, so update any links, printed material and directory listings that point to it.
If you use your own domain name, you own and pay for that domain and are responsible for keeping it registered. We can connect it to your fitweb site while your site is active. If you leave fitweb, your domain remains yours to point elsewhere.
Bespoke and custom-built sites are different: ownership, hosting, and any handover are set out in your individual project agreement, which may include transferring the site to you to run yourself.
You agree not to use fitweb to:
fitweb reserves the right to suspend or terminate any account that breaches these terms, without refund.
The list above is a summary. Our full Acceptable Use Policy sets out what is and is not permitted on fitweb-hosted sites, and applies in addition to these terms.
We aim to keep the fitweb platform available at all times but do not guarantee uninterrupted service. Scheduled maintenance, Cloudflare infrastructure issues, or circumstances outside our control may affect availability. fitweb is not liable for losses arising from downtime.
fitweb is built on third-party infrastructure, including Cloudflare, Stripe, Resend and Anthropic. Interruptions to those services may affect fitweb, and we are not liable for their failures.
We may add, change or remove features as the platform develops. We will not make changes that materially reduce the core service you are paying for without giving you notice.
To the maximum extent permitted by applicable law, fitweb's liability to you is limited to the amount paid for the service by you or on your behalf in the 12 months preceding the claim.
fitweb is not liable for indirect, consequential, or loss-of-profit claims arising from your use of the service.
Nothing in these terms limits liability for death, personal injury, or fraud.
Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot be excluded by agreement. Where you acquire fitweb for the purposes of a business, the Consumer Guarantees Act does not apply.
We will send you service emails about your account and site, which you cannot opt out of while you hold an account. We may also send you tips and updates about getting the most from fitweb. You can opt out of those at any time using your dashboard settings, an unsubscribe link where one is included, or by emailing us and asking to be removed.
You may stop using fitweb at any time. If you do not renew your annual hosting, your site will come offline at the end of your current period.
fitweb may suspend or terminate your account if you breach these terms, fail to pay, or if we are required to do so by law. Where possible, we will notify you before taking action.
We may update these terms, or any of the policies that form part of them, from time to time. When we do, we'll update the date at the top of the page that changed. For significant changes, we'll notify you by email at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
We may transfer these terms and your account to another entity as part of a sale, merger or reorganisation of our business. You may not transfer your account to someone else without our agreement.
If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a term straight away, we do not lose the right to enforce it later. Neither party is liable for failure to perform caused by events outside their reasonable control.
These terms, together with the policies they incorporate, are the entire agreement between us. The sections covering your content, limitation of liability, and governing law continue to apply after your account ends.
These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
