Acceptable Use Policy

This policy sets out the rules for using the fitweb platform. It applies to all users: personal trainers, gym owners, and anyone accessing fitweb services. By using fitweb, you agree to this policy.
fitweb is operated by AscendX Limited (trading as fitweb), based in Christchurch, New Zealand.
The spirit of this policy
fitweb exists to help fitness professionals build credible, professional websites and sustainable businesses. This platform is built on trust: trust between fitweb and the professionals who use it, and trust between those professionals and the clients who visit their sites.
Use the platform in that spirit. The rules below exist to protect everyone on it.
What you must not do
Misrepresentation
- Provide false or misleading information about your qualifications, experience, or services
- Claim certifications or registrations you do not hold
- Impersonate another person, trainer, or business
- Use a business name or brand that infringes another party's trade mark or intellectual property
Harmful or unlawful content
- Publish content that is defamatory, discriminatory, threatening, or harassing
- Promote services that are illegal in New Zealand or in the jurisdiction where your clients are located
- Include content that sexualises minors or facilitates harm to any person
- Publish content that violates the New Zealand Human Rights Act 1993 or the Bill of Rights Act 1990
Platform abuse
- Attempt to gain unauthorised access to fitweb's systems, infrastructure, or another user's account
- Probe, scan, or test the platform for vulnerabilities without written permission from fitweb
- Use automated tools to scrape, crawl, or extract data from fitweb sites without permission
- Introduce malware, viruses, or malicious code into the platform or any fitweb site
- Interfere with the availability or performance of the fitweb platform for other users
Commercial misuse
- Resell or sublicense access to the fitweb platform without written agreement
- Use your fitweb site to promote businesses or services unrelated to fitness without prior approval
- Use the platform in a way that could damage fitweb's reputation or the
fitweb.io domain
Content standards
All content published through fitweb must:
- Be accurate and not misleading to prospective clients
- Comply with the New Zealand Fair Trading Act 1986: no false or misleading representations about your services or pricing
- Comply with the Advertising Standards Authority guidelines where applicable
- Not infringe the copyright, trade marks, or other intellectual property rights of any third party
- Not include unsolicited commercial messaging (spam)
fitweb reserves the right to review, edit, or remove any content that does not meet these standards.
Lead handling
When visitors submit enquiries through your fitweb site, you receive their contact details as leads. You must:
- Use lead data only to follow up on the enquiry, not for unrelated marketing without explicit consent
- Handle lead data in accordance with the New Zealand Privacy Act 2020
- Not sell or share lead contact details with third parties
REPs registration
If you access fitweb through your REPs PT Contractor registration, your fitweb site is contingent on maintaining that registration. You must not:
- Claim to be REPs-registered if your registration has lapsed
- Use your fitweb site to misrepresent your current registration status to clients
Enforcement
fitweb monitors for breaches of this policy and investigates all reports. If we determine that you have breached this policy, we may:
- Issue a warning and request you correct the issue
- Suspend your site while an investigation is underway
- Permanently terminate your account without refund
- Report unlawful activity to the relevant New Zealand authorities
We will notify you before taking action where it is safe and practical to do so.
Reporting a breach
If you become aware of a fitweb site or user that may be in breach of this policy, please contact us at hello@fitweb.io. We take all reports seriously and will respond within two business days.
Changes to this policy
We may update this policy from time to time. When we do, we'll update the date at the top of this page. For significant changes, we'll notify you by email at least 14 days before they take effect.
